On June 12, 2025, EIC joined the Cal Chamber and other business organizations in a letter opposing placeholder trailer bill language in the Senate’s proposed budget that would exempt rulemakings for SB 253/SB 261 – climate disclosure rules – from Standardized Regulatory Impact Assessment (SRIA) and California Environmental Quality Act (CEQA) requirements. On December 2, 2021, EIC filed an amicus brief with the Supreme Court in Ferrellgas Partners LP v. Direction, Division of Taxation (Department of the Treasury of the State of New Jersey) in support of Ferrellgas. Ferrellgas challenged New Jersey’s imposition of an un-apportioned annual levy (up to $250,000 per year) claiming it was a violation of the Commerce Clause. New Jersey state court denied the claim and Ferrellgas has sought review before the Supreme Court.

On February 18, FERC reopened its review of the 1999 Policy Statement on the certification of new interstate natural gas facilities - Docket No. PL18-1-000. This effort is intended to build upon FERC’s April 2018 Notice of Inquiry (NOI). FERC is looking for new information and additional perspectives to help guide its review. As such, this NOI reissues prior questions raised in the 2018 NOI, modifies some of these prior questions (primarily concerning the scope of authority for NEPA review and GHG emissions), and adds a new category of questions on Environmental Justice.

Energy Infrastructure Council Expresses Deep Concern over Court Decision to Shut Down Dakota Access Pipeline

(Washington, DC) Energy Infrastructure Council (EIC) President & CEO Lori Ziebart today issued a statement expressing deep concern over the decision by Judge James E. Boasberg of the U.S. District Court for the District of Columbia to temporarily shut down the Dakota Access Pipeline pending an environmental review. Today, July 29, 2019, the Energy Infrastructure Council (EIC) announces its formation. EIC’s membership includes and is open to traditional and renewable energy infrastructure companies irrespective of company form, including public and private C-corporations, LLCs and partnerships, MLPs, infrastructure REITS and Yieldcos. The formation of EIC reflects the desire to adapt to the evolving industry landscape for companies developing and operating energy infrastructure and to address core public policy issues critical to investment in America’s energy infrastructure.
